On April 23, 2019, Tennessee Governor Bill Lee signed into law that employers who adopt the state’s model anti-bullying policy will be granted immunity from workplace-bullying lawsuits.
While state and local governmental entities were already covered under the state’s Healthy Workplace Act, H.B. 856 now expands this act to also cover private employers effective immediately. Tennessee employers are currently exposed to state court lawsuits alleging “infliction of mental anguish based on its employees’ abusive conduct” if a worker believes they have been the victim of bullying. Under this new law, however, an employer who adopts the model policy created by the Tennessee Advisory Commission on Intergovernmental Relations can receive legal immunity.
In order to ensure our Company Policies Smart App customers in Tennessee are in compliance with the new law, we updated the name of the policy to the Tennessee Abusive Conduct Prevention Policy as well as added additional content to reflect that the new law provides immunity to employers if they adopt the workplace bullying policy.
