The South Carolina Job Application has been updated to be in compliance with a new law allowing criminal records to be expunged. Therefore, the criminal history question has been updated to include "You are not obligated to disclose expunged charges." on the Job Application Smart App for customers in South Carolina.
In early September, South Carolina amended it’s criminal records law allowing certain criminal records to be expunged if followed by a successful court petition. What this means is that employers are not able to consider an applicant’s expunged criminal information when making employment decisions and therefore, we have limited our criminal question to reflect this change on our job application. The law is intended to help those individuals who have been convicted of juvenile offenses, first offenses, and relatively minor drug offenses, in order to help alleviate the labor shortage that the state is currently experiencing. South Carolina’s new law takes effect on January 1, 2019.
In order to make sure our customers are in full compliance, we recommend that all current paper job applications should be discarded, and new, updated versions printed from the Resources tab in the app.
